PLEASE READ THESE TERMS CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION ABOUT HOW YOU CAN ACCRUE AND USE YOUR POINTS THROUGH RENTLY.

1. Definitions & Interpretation
In these terms, unless the context otherwise requires, the following words and expressions shall have the following meanings:
"Member" means an individual who has registered for and uses the Rently app and participates in the Points Scheme.
"Points" means the reward points earned by Members through the Points Scheme which can be exchanged for gift cards or offers with Points Partners.
"Points Partners" means selected brands and businesses with which Members can collect and redeem Rently Points."Privacy Policy" means Rently's privacy policy available at https://brickrewards.co.uk/legal/privacy-policy.
"Points Scheme" means the Rently Points Scheme as described in clause 2 of these terms.
"Terms of Use" means Rently's general terms of use available at https://brickrewards.co.uk/legal/terms-and-conditions.
1.1. Clause, Schedule and paragraph headings shall not affect the interpretation of this agreement.
1.2. A person includes a natural person, corporate or unincorporated body (whether or not having separate legal personality).
1.3. A reference to writing or written include email but excludes fax.
1.4. Any obligation in this agreement on a person not to do something includes an obligation not to agree or allow that thing to be done.
1.5. A reference to this agreement or to any other agreement or document is a reference to this agreement or such other agreement or document, in each case as varied from time to time.
1.6. Any words following the terms including, include, in particular, for example or any similar expression shall be interpreted as illustrative and shall not limit the sense of the words preceding those terms.
1.7. This agreement shall be binding on, and enure to the benefit of, the parties to this agreement and their respective personal representatives, successors and permitted assigns, and references to any party include that party's personal representatives, successors and permitted assigns.
2. The Rently Points Scheme
2.1. The Rently Points Scheme (the "Points Scheme") allows members to earn points primarily by paying rent on time. We may award points separately from time to time at our discretion in connection with promotions we run from time to time, such as on your birthday or for following us on your social media accounts (etc).
2.2. Members can also earn daily points on spending with Rently’s Points Partners. Points awarded will depend on transaction value and is tracked through your bank account permissions you grant to us.
2.3. Members can exchange their accumulated points for gift cards or offers which can be redeemed with participating Points Partners.
2.4. “Points Partners” are selected brands and businesses with which Members can collect and redeem Rently points.
2.5. All transactions and rent payment verification are processed through open banking technology. You need to grant permission through your banking application(s) to share your data with us for rent verification purposes.
2.6. Participation in the Points Scheme is subject to these Points Scheme terms, Rently’s Terms of Use, and Privacy Policy. Participation in the Points Scheme is free; however this is always at Rently’s discretion.
2.7. Rently is a free app available to use on Apple and Android devices. Rently can be downloaded via the App Store or Google Play Store.
2.8. By participating in the Points Scheme, you confirm that you have read, understood and agree to the Points Scheme terms. No other terms apply. If you do not agree to the terms, you should not participate in the Points Scheme.
3. How to collect
3.1. To collect Rently points you must be aged 18 or over, be a resident of the United Kingdom and have a valid Rently account. You must be a tenant or renter of a residential property. The Points Scheme does not apply to homeowners or mortgage holders.
3.2. To sign up for a Rently account you will need to provide open banking data, your name, your email address and your postal address.
3.3. Members are entitled to one Rently account only. Rently reserves the right to refuse, merge or close additional accounts at any time.
3.4. To be awarded Rently points, Members must undertake one or more of the qualifying activities set out in clause 2.1 above.
3.5. For rent payments made on time, Members will earn 1 point per £1 payment. Points will typically be credited to your Rently account within 3-5 business days of verification of your on-time payments through open banking.
3.6. The frequency of rent payments (e.g. weekly, monthly, quarterly, annually) does not affect eligibility to earn points, provided that each payment is made on time. Points will be awarded per qualifying payment made; points are not credited for rent payments that are made late.
3.7. The number of points awarded may change from time to time. Rently will where possible provide reasonable notice of any changes to points allocation. The value of points allocated is at Rently’s discretion and subject to change.
4. How to spend
4.1. Rently Members will be able to browse available offers when logged into the Rently app. Rently points can be redeemed on a variety of rewards, including:
> Digital gift cards or vouchers issued by approved third party partners;
> Offers, discounts or complimentary items from participating Points Partners;
> Points transfers or exchanges into other loyalty programs (such as Nectar, Clubcard or similar);
> Entry into any Rently promotions that we may operate from time to time, including rent giveaways or other prize draws; and/or
> Offsetting certain in-app features or services (such as any Rently subscription fees or rent reporting features.
4.2. Third party partners may vary from time to time and the use of offers from third party partners is subject to third party terms.
4.3. Rently points have no monetary value and cannot be exchanged for cash. Typically, as a guide only, we expect 1,000 Rently points to typically equate to £5 but this will vary depending on Points Partner and rewards type, and is subject to change. Points cannot be used to pay for future rent payments.
4.4. You can spend points up to your available points balance in increments determined by our Points Partners. Points values may vary between Points Partners and certain Points Partners may have minimum redemption value requirements, and redemption values may vary over which Rently has no control.
4.5. When you request to convert your Rently points into gift cards, your points balance will be reduced accordingly. Once your Rently points have been redeemed for gift cards, they cannot be exchanged back into points.
4.6. Each gift card is issued by Rently and can only be used to obtain goods or services from authorised Points Partners.
4.7. Gift cards will be made available to you through the Rently app and can be presented digitally at the point of redemption.
4.8. For in-store redemption, simply present your Rently gift card or offer at the till and the cashier will scan the offer from your Rently account.
4.9. Only one gift card or offer can be used per transaction. A gift card or offer code can only be used once and is not valid beyond the expiry date detailed on the offer. Expired gift cards cannot be redeemed or extended.
4.10. Gift cards and offers cannot be used as part payment and are subject to the individual terms and conditions of the relevant Points Partner and any restrictions they may impose.
5. Restrictions & exclusions
5.1. Items included in your Rently offers are selected at Rently’s discretion and are subject to change. All offers are subject to availability and may be subject to limitation.
5.2. Rently reserves the right to withdraw products, change the products on offer at any time or change the Points Partners Rently partners with.
5.3. You cannot use your Rently gift cards in conjunction with any other offer or discount unless expressly stated otherwise.
5.4. Rently points are non-transferable and can only be used by the Member who is named and registered on the account. Rently points and gift cards cannot be bought, sold, gifted, traded or otherwise transferred in any way.
5.5. Rently is for personal and consumer use only and must not be used for any business transaction purposes.
5.6. Rently points that are not used after issue will remain in your Account until your Account is closed. If you:
> close your Account, any accrued points will be forfeited from the point of closure; or
> no longer maintain an active bank account connection, your accrued points will remain in your Account for 12 months after the date your connection closes (after which point, they will be forfeited).
5.7. Following Account closure or where you no longer have an active bank account connection, you can continue to redeem points for up to 12 months but you won’t be able to accrue further points. Unused or expired points cannot be refunded or exchanged.
5.8. Digital gift cards may be subject to their own expiry dates, which you must monitor as rewards cannot be exchanged back for points if your gift card(s) are not used before their relevant expiry date(s).
5.9. Rently is entitled to remove Rently points from a Member’s account at any time in accordance with clause 6.3 below.
6. Disclaimers
6.1. Rently points are awarded in accordance with clause 2.1 above. If Rently determine that points were collected in breach of these Points Scheme terms or were awarded in error, then these points may be revoked.
6.2. Rently points cannot be applied retrospectively. You cannot earn or redeem points for transactions, rent payments, or other activities completed before you enrolled in the Points Scheme.
6.3. Rently may remove a Member from the Points Scheme if there is a reasonable belief of any abuse or attempted abuse of the Points Scheme or breach of the Points Scheme terms relating to the Points Scheme. Examples of abuse or breach include but are not limited to: supplying false or misleading information, having Rently accounts in fictitious names, having multiple Rently accounts, claiming points not collected from users own transactions, or manipulating the points system through fraudulent means.
6.4. If your account is closed for any reason under clause 6.3, your points will be forfeited immediately and will not be available to you.
6.5. Rently makes no guarantee that any particular Points Partner will remain part of the Points Scheme or that any particular gift card or offer will remain available. Where a Points Partner fails to honour any points redemption, this is a matter for you and the relevant Points Partner to resolve.
6.6. Any dispute regarding goods or services obtained from Points Partners must be resolved directly with the relevant Points Partner.
6.7. To the extent permitted by law, Rently excludes all liability for any loss or damage arising from Members’ participation in the Points Scheme. Nothing in these Points Scheme terms excludes or limits Rently’s liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
6.8. Where appropriate, Points Partners who offer rewards to Members may receive information from Rently that will assist with the promotion, management and effectiveness of that reward, as explained in Rently’s privacy policy.
6.9. If any redemption of Rently rewards or participation in the Points Scheme is subject to, or has any, personal tax implications for you, this is your sole responsibility.
7. Notices
7.1. It is your responsibility to keep personal details updated on your Rently account.
7.2. Any notices or communications regarding the Points Scheme will be sent to the email address registered on your Rently account.
7.3. It is your responsibility to ensure that your contact details are current and accurate.
7.4. Rently may also communicate with you through in-app notifications regarding your points balance, available offers and changes to the Points Scheme.
7.5. Rently reserves the right to change these Points Scheme terms at any time for legal, regulatory, business or policy reasons, or withdraw the Points Scheme in full. Members who continue to participate in the Points Scheme following any change to the Points Scheme terms will be considered to have accepted the updated terms.
8. General
8.1. You can choose to leave the Points Scheme at any time. If you wish to leave the Points Scheme you should close your Rently account through the app or by contacting Rently customer support. Upon leaving the Points Scheme, Members forfeit the right to any points already accrued and any unredeemed gift cards.
8.2. These terms are governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.
8.3. A person who is not a party to these terms shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these terms. This will not affect any right or remedy of a third party which exists or is available apart from that Act.
8.4. Rently’s failure to enforce any provision of these terms shall not constitute a waiver of that provision or any other provision.
8.5. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
8.6. For questions about the Points Scheme, please contact Rently at support@rently.co.uk. If you need to raise any issues with us relating to the Points Scheme at any time, please contact us in the first instance with sufficient details about your complaint so that we can resolve it. We will endeavour to respond to all queries within 3-5 working days.
8.7. If you are not satisfied with how we have responded to any query you have raised with us, please let us know in writing and we can either escalate the matter internally, or refer you to the relevant ombudsman for additional support.
