Privacy Policy

RENTLY SOLUTIONS LIMITED (we/us/our) are committed to respecting your privacy and protecting your personal data. We recognise that your personal data is your property and that you have loaned it to us for specific purposes.

Unless otherwise required by law, the Information Commissioner’s Office (ICO) guidance or best practice, or to perform our contract with you, we will only process your personal data in the way we tell you or in the way you ask us to, and we will stop processing it and irretrievably delete it, wherever possible.

1. This policy

1.1. This policy, together with our terms of use at www.rently.co.uk (our Website/App/Rently) and points scheme terms, applies to your use of the Website/App and sets out how we will process your personal data.
1.2. This policy applies to our contract with you. You are therefore advised to read it carefully. Terms used within it shall have the meaning(s) given in the Data Protection Act 2018 (Act) and/or the UK and EU General Data Protection Regulation (2016/679) (Regulation), as applicable.
1.3. By using Rently, or by providing your personal data to us, you understand, accept and consent to the practices described in this policy.
1.4. Any changes we make to this policy will be posted on this page. You are advised to check back frequently as, unless your consent is required, any changes will be binding on you when you continue to use the Website/App or work with us after the date of the relevant change.
1.5. For more information relating to your rights under this policy, please see section 9.

Where you contact us, your correspondence (and any personal data contained within it) will be processed by us.

2. Who we are

2.1. For the Act, the data controller is Rently Solutions Limited a company registered in England and Wales under the number 15833718 with its registered office at 29 Arboretum Street, Nottingham, Nottinghamshire, United Kingdom, NG1 4JA.
2.2. We are registered with the ICO to process your personal data and our registration number is ZB724854.
2.3. Your personal data will be held and stored by us in our internal management information systems on servers located in the UK. All personal data is processed by UK based staff who are regulated by our internal staff data protection policy.
2.4. Our databases are backed up both on and off site and automatically encrypted on Cloud-based servers located within the EEA. All data that is backed up is encrypted.

3. Your consent

3.1. We do not ordinarily rely on your consent to process your personal data for the purposes of registering your account with Rently. However, we need access to your banking applications to verify payments, which needs your consent. If you withdraw your consent to your bank account access at any time, you will not be able to accrue points or optimise your use of Rently.
3.2. By granting us access to your bank account transactions, you agree to allow us to process your personal data in accordance with this privacy policy. Access to your bank account(s) is facilitated by our open banking provider who facilitates the bank connection and subsequently shares the information back to us.
3.3. We process your personal data primarily to perform our contract with, and provide our service to, you. We consider the personal data we obtain is reasonable and necessary for these purposes. However, we review this intermittently and remove any inaccurate or obsolete data.
3.4. You cannot use Rently without accepting this privacy policy. You are prompted to do so on account registration and we record this acceptance during the onboarding process.
3.5. By using Rently, you agree to:
3.5.1. the transfers of your personal data to those specifically listed third parties in this policy, for the reasons specified; and
3.5.2. us using your personal data for direct marketing purposes in future.
3.6. You may exercise your rights under section 9 at any time, which includes withdrawing your consent to our processing of your personal data. However, where this withdrawal prevents us from performing our contract with you, you may not be able to use Rently or access your account.

4. Data we collect

4.1. We only collect personal data from our Rently account holders. We will collect all information set out on our account registration pages to enable you to register with and use Rently, including name, address, email and date of birth. Age is requested via date of birth during the onboarding process.
4.2. As part of the onboarding flow, you are prompted to link your bank account to allow us to:
4.2.1. confirm your rent payments every month; and
4.2.2. view other transactions to enable us to reward your with points for shopping at our partners.
4.3. To provide Rently to you, you authorise us to obtain, verify and record information and documents that helps us verify your identity and bank account information. We may require you to provide and/or confirm information to enable us to identify you.
4.4. We also monitor your use of Rently through your account. This includes how you interact with Rently and decisions you make with regard to your points.
4.5. Where you use your points with any of our partners, any data you provide to those partners will be used by them and will be subject to their privacy policies, over which we have no control.
4.6. For staff, where you are a current, potential or former employee, worker or other member of our staff, we may collect additional categories of your personal data for the purposes of providing you with the necessary benefits under our contract with you. In those circumstances, a separate privacy notice applies and a copy is available on request.
4.7. We do not process any special category personal data at any time.

5. How we collect your personal data

5.1. When you provide it to us
> Your personal data is primarily provided to us when you register to use Rently
> If you correspond with us by phone or email, any personal data contained in that correspondence (including your IP address and location) will be retained by us
5.2. When we collect it from you
> When you use our Website/App, we will automatically collect technical information about the device you use to visit, including your IP address, browser type/version and related settings.
> We also monitor your use of our Website/App. This includes the full URLs, your clickstreams through our Website/App, the pages you view and how you interact with them and how you leave the Website/App.
5.3. When we receive it from others. We do not currently receive personal data relating to you from third parties and we do not share personal data with third parties on your behalf.
5.4. We share personal data with:
> our open banking partner, Moneyhub Financial Technology Limited (number 06909772). Moneyhub is authorised and regulated by the Financial Conduct Authority (FCA) as both an Account Information Service Provider and a Payment Initiation Service Provider (ref. number 809360). All personal data shared with Moneyhub should be processed in accordance with their privacy policy available at Global Privacy Policy (including Cookies Statement) - Moneyhub; and
> Experian, Equifax and TransUnion as part of our rent reporting service, where you expressly enable and allow us to do so.
5.5. We do not currently share personal data with any third parties for marketing purposes.
5.6. Rently uses Google Analytics, a web analytics service provided by Google, Inc. (Google). Google Analytics uses "cookies", which are text files placed on your computer to help analyse how you use the Website/App. The information generated by the cookie about your use of the Website/App (including your IP address) will be transmitted to and stored by Google on servers in the USA. Google will use this information for the purpose of evaluating your use of Rently, compiling reports on your activity for us and providing other services relating to Rently activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google.
5.7. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this your ability to use Rently may be restricted. By using Rently, you consent to the processing of data about you by Google in the manner and for the purposes set out above.
5.8. Rently also has its own data lake for storing analytics data hosted by Rudderstack, Inc, and based out of the USA (California). Data remains hosted from within the UK.

6. What do we use it for

6.1. Your personal data is primarily required to enable you to use Rently.
6.2. We also use your personal data to send you information by email about us, our services and those of our partners that may be similar to those you have already purchased or enquired about. We only do this where you have given us permission to do so, and you can opt-out at any time. Where you opt out, we will no longer contact you until you ask us to, and we will not prompt you to do so.
6.3. If your personal data is processed by third parties in connection with third party products and services that you may have used through Rently, those third parties may retain your personal data subject to their privacy policies, and if you wish to opt out of any marketing communications you receive from them you will need to notify them directly.
6.4. Technical information we collect about your visit to our Website/App is used to enable us to:
> personalise and improve its functionality and security (to keep it safe and secure);
> administer and monitor traffic and behaviours on our Website/App for analysis, testing, research, statistical and survey purposes; and
> ensure that we can offer you the most effective and efficient browsing experience, and make improvements where necessary.
6.5. Where we change our services, or any applicable terms and conditions, we will contact you.
6.6. Once collected, your personal data will be retained by us for as long as you have an account with us. After this point, the data will be securely deleted and we will not contact you unless you ask us to.

7. Data security

7.1. All data stored through Rently is Cloud-hosted. Data is stored in Google Cloud and access is held behind a role-based API integration. All data at rest and in transit is encrypted.
7.2. As we are start-up organisation with data in limited volumes currently, we do not currently have any IT certifications for our IT systems.
7.3. Data can be kept up to date via users through our customer support integrations.
7.4. We securely remove all user personal data when the relevant Rently account is closed. Once the account is closed, data is anonymised and only backed up for a limited period, after which point it is irretrievably removed from our systems and backup servers.

8. Data disclosures

8.1. Data is only disclosed to those third parties listed in section 5.4, for the purposes listed in that section.
8.2. Any websites which are linked from the Website/App are outside of our control and not covered by this policy. If you access those websites using the links provided, the website operators may collect information from you which will be used by them in accordance with their own privacy policies (if any). These policies may differ from ours, and we cannot accept any responsibility or liability in respect of these.
8.3. We may disclose your identity and information relating to your bank account(s) with third parties if required by applicable law or court.

9. Cookies

9.1. Rently uses cookies to distinguish you from other users. This helps us to provide you with a good experience when browsing, and allows us to improve our site.
9.2. Cookies are small files of letters and numbers that we store on your browser or hard drive (if you agree). They contain information that is transferred to your hard drive.
9.3. You can choose which analytical, functionality or targeting cookies we can set by clicking on the buttons in the cookie banner. You can also choose to reject all cookies.
9.4. Except for essential cookies, all cookies will expire after 12 months.

10. Your rights

10.1. In relation to your personal data, you may (in addition to any rights you may have under the Act or the Regulation) ask us:
10.1.1. not to process your personal data for marketing purposes;
10.1.2. to clarify what data we hold about you, how it was obtained, to whom it has been disclosed and for how long it will be stored;
10.1.3. to amend any inaccurate data we hold about you;
10.1.4. to delete any of your data (where you no longer think we need to hold it, or you think we have obtained or processed it without your consent at any time); and
10.1.5. to only process your personal data in limited circumstances, for limited purposes.
10.2. We have the capacity to extract your personal data from our databases and provide it to you in a structured, commonly-used way through a dashboard in non-SQL form via command line query for single users.
10.3. If you wish to exercise any of your rights at any time, please contact us on the details contained at the beginning of this policy or through the Rently app in the first instance. We will require you to verify your identity to us before we provide any personal data, and reserve the right to ask you to specify the types of personal data to which your request relates.
10.4. Where you wish to exercise any of your rights, they may be subject to payment of a nominal administration fee (to cover our costs incurred in processing your request) and any clarification we may reasonably require in relation to your request. Such fees may be charged where we consider (acting reasonably) that your request is excessive, unfounded or repetitive.
10.5. If you have any concerns that you consider we have not dealt with sufficiently, you may escalate these to the Information Commissioner’s Office (“ICO”) at any time. Details of how to do this are available on the ICO’s website.
